Please review these Terms of Service ("Terms") carefully before using the Sabes Pro desktop application, VST3 companion plugin, and associated cloud services operated by SkyWay Mark Trading Ventures.

1. Acceptance of Terms

By creating an account, downloading, installing, or using Sabes Pro, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately cease using the software.

2. Software License & Permitted Use

Subject to your active license tier (Free, Plus, Studio, or Lifetime), SkyWay Mark Trading Ventures grants you a personal, revocable, non-exclusive, non-transferable license to install and operate Sabes Pro on compatible hardware for audio project management, version tracking, and take certification.

3. Billing, Merchant of Record & Subscriptions

All software license purchases, subscriptions, and invoice generation are handled through our Merchant of Record, Paddle (Paddle.com Market Limited). Paddle is responsible for billing inquiries, transaction security, VAT/sales tax handling, and customer receipts.

4. User Responsibilities & Acceptable Use

You agree not to reverse engineer, decompile, modify, or create derivative works from the application binaries, nor use the cloud service to distribute malicious code, violate copyright, or bypass licensing controls.

5. Local-First Architecture & Data Ownership

All intellectual property rights in your music projects, audio stems, and DAW session files remain 100% yours. Sabes Pro operates on a strict local-first architecture and does not claim ownership or access to your creative assets.

6. Disclaimer of Warranties & Limitation of Liability

The software is provided "as is", without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, in no event shall SkyWay Mark Trading Ventures be liable for any indirect, incidental, or consequential damages.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar, India.
